First Time Home Buyer & Repeat Buyer Tax Credit
QUESTIONS & ANSWERS Explained

 

All new first time home buyer and repeat buyer Tax Credit are effective immediately. It does not have to occur on December 1 2009 in order to qualify. All closings occurred on November 6 2009 qualifies for the new & improved first time home buyer and repeat buyer tax credit.

First Time Home Buyers

The $8,000 first time home buyer tax credit applies to home buyers that purchase homes at $80,000 or more. Anything less than $80,000, the tax credit that applies is 10% of the purchase price.

Repeat Buyers

  • There is NO PROVISION that stipulates that the Repeat Buyer must purchase a home more expensive than the one sold.
  • There is NO PROVISION that says the Repeat Buyer must sell the home before the new one close.
  • Qualifying sale of existing principal residence must be any five-consecutive year period during the eight-year period that ended on the date the replacement home is purchased.

New Income Limits

  • For home purchases on or after November 6 2009, new income limits raised to Modified Adjusted Gross Income of $125,000 for a full refund and phase out adjustment up to $145,000 for single taxpayer.
  • Modified Adjusted Gross Income of $225,000 and phase out adjustment up to $245,000 for married taxpayers.

Purchase by a Dependent

There was no age limitation on the original bill and amended for the November Tax Credit. Taxpayer must be at least 18 years old to qualify for the credit. For married taxpayers, the taxpayer shall be treated as meeting the age requirement if the taxpayer or spouse meets the age requirement.

Repeat Buyers

There is no criteria that home buyers must "move up" in house. Only that they lived in the house for the past 5 out of 8 years as a primary residence. The new purchase price must not exceed $800,000.

Date of Enactment = November 6 2009.

For 2008 Purchases

For home purchases in 2008, the tax credit works as if it is a 15-year no-interest loan up to $7,5000. The total amount of tax credit equals 10% of home purchase price.

For 2009 Purchases

For home purchases in 2009, the tax credit is 10% of purchase price to a maximum of $8,000. On or after November 6 2009, repeat buyers qualify also.

Tax credit:

  • Applies to taxpayer's principal residence
  • Reduces taxpayer's tax bill, dollar for dollar
  • Is fully refundable which means if the taxpayer is eligible and owes no tax, taxpayer will receive a full refund.

When to File For This Tax Credit

First time home buyers who purchase a home in 2009 can claim the tax credit on 2008 tax return by filing for an amended return or 2009 tax return. Credit may not be claimed before closing.

The credit is claimed using Form 5405 with an original or amended tax refund.

To file an amended tax return, use Form 1040X.

Open Letter to Missoula Montana First Time Home Buyers

 

Great information for Missoula & Western Montana Real Estate Buyers and Prospective Homeowners:

Dear Procrastinating First Time Home Buyers:

 

I know you.  I've seen you in the mall on December 23rd. I've watched you race through town en route to the airport; screeching up to the terminal just in time to prevent your mom from giving up and getting in the cab.  I even saw you run over the neighbor's cat on your way to the post office on April 15th.  (Actually, disregard that last one.  I'm sure it was just a large stick).  You excel when the stakes are high.  You thrive on knowing you'll succeed where mere mortals would stumble.  Your methods are a bit unorthodox, but you always come through at the buzzer.  In most circles, I would be you.

The significant difference here is that I own a house.  For better or worse, I don't have a stake in the $8000 tax credit game.  You do though.  You have the opportunity to change your life for the better and you plan to do so. Tomorrow. 

My only concern is that tomorrow may not be when you think it is.  By now, you know the tax credit expires December 1st.  As this is month's away, I'm sure you've given little thought to actually looking for a house.  There are far more pressing deadlines to be dealt with.  I know you are busy, so I won't take up much more of your time.  But, you need to know...

December 1st is the wrong date.

To be eligible for the credit, you have to take possession by December 1st.  When everything was working well, it took around 30 days to close a loan.  These days, things don't work well very often and it's not going to get better once you and your brethren leave the couch.  Underwriters are scarce and banks aren't about to staff up for the onslaught knowing there is a going to be a huge void immediately afterwards.  It will take at least 45 days to close.  With that in mind,

October 16th is the real drop-dead date.

Reset your internal clock. 

NOW!!

 

I'd tell you to start now, so you can take advantage of the best deals, but it would be a waste of breath.  So, I'll just say,"Call me when you are ready."

Has the Missoula Montana Real Estate Market Stabilized?

Missoula Real Estate MarketSo What's Up with the Missoula Real Estate Market? National reports show that the real estate market is improving. The National Association of Realtors just reported that home sales rose in 3.6% June, marking five consecutive months of improvement for the first time since 2003. 

While things are heading the right way on a national level, all real estate markets are local. The Missoula Real Estate Market is no different.

It is important to keep in mind that the Missoula real estate market has not seen the same type of declines that have been highly publicized in other parts of the country. The median home price in Missoula County-$217,000 as of June 30, 2009 has fallen less than 1 percent since its peak in 2006, according to the Missoula Organization of Realtors.

And, we are already starting to see improvement. The first quarter 2009 remained fairly steady, numbers for the second quarter appear to be seeing increased sales activity in some price ranges. 

For example:

  • Sales under $150,000 are fairly flat; however there isn't a lot of inventory in that price range. 
  • On the other end of the spectrum, sales in the $350,000 and higher price range are also fairly flat
  • We have seen an increase in activity over the last two quarters in the $150,000 to $275,000 price range. 

Owning a Home is Still the American DreamSo to answer the question, has the Missoula Market Stabilized? The signs are good. We are not seeing significant decreases in the median home price, and home sales in the mid-price range are actually improving. We are seeing increased buyer activity at our real estate office and are optimistic about the future of the market.

Home ownership is still the goal for most Americans with over two thirds of households in our country prefering to own their home, and with incentives to buy like low interest rates and the $8,000 First Time Home Buyer Tax credit, now really is a good time to buy in Missoula.
